PENERAPAN SANKSI PIDANA “ULTIMUM REMEDIUM” TERHADAP KEJAHATAN BISNIS DI BIDANG PASAR MODAL DI INDONESIA

Abstract

Pasar Modal yaitu aktivitas yang berhubungan terhadap perdagangan efek dan penawaran umum. Industri publik yang berhubungan terhadap Efek. Pasar Modal berimplikasi pada Peran terhadap waktu yang akan datang berhubungan terhadap Perekonomian Indonesia Serta mempunyai fungsi perekonomian dikarenakan menyajikan sarana ataupun tempat menjumpai beberapa kepentingan. Peran besar tersebut tidak sedikit menimbulkan Kejahatan Bisnis di Bidang Pasar Modal maka perlu mengetahui dan memahami Penerapan Asas Ultimum Remedium pada Kejahatan Pasar Modal di Indonesia serta untuk mengetahui dan memahami Pengenaan Sanksi Pidana Terhadap Perlindungan Hukum Pada Kejahatan Bisnis Di Bidang Pasar Modal. Perlindungan hukum terhadap investor pada Kejahatan pasar modal (Penipuan, Manipulasi Pasar, dan Perdagangan Orang Dalam) di Indonesia diatur secara lengkap pada UU No. 8 Tahun 1995 mengenai Pasar Modal Undang-undang Pasar Modal dengan peraturan prinsip keterbukaan, berupa sanksi administratif, pidana dan perdata. Bahwa dalam menyatakan secara implisit hukum pidana sebagai sarana hukum Ultimum Remedium dan Penerapan sanksi pidana terhadap kejahatan bisnis di bidang pasar modal UU Pasar Modal secara tegas mengatur mengenai dua bentuk sanksi yaitu sanksi administratif dan pidana.

Capital Market is an activity related to Public Offering and Securities Trading, Public Company associated to securities. The Capital Market has implications of the role in the future that is linked to the Indonesian economy and has an economy function since it offers facilities or places that draw several interests together as one. The big role doesn’t set bounds the business crimes in the Capital Market sector thus knowing and understanding the Application of the Ultimum Remedium Principle as well as the Imposition of Sanctions against Legal Protection on Business Crimes is very important in the market sector. Legal protection for investors in capital market crimes (Fraud, Market Manipulation, and Rigged Market) in Indonesia is fully regulated in the Law Article Number 8 of 1995 regarding to the Capital Market Law through principle regulations of transparency, in the form of administrative, criminal and civil sanctions. That states implicit criminal law as a legal means of Ultimum Remedium and the application of criminal sanctions against business crimes in the market sector. The Capital Market Law explicitly control the sanctions mainly two of them, administrative and criminal sanctions
